The Terms and Conditions of Mufti, The Islamic Consultant and the Consultee in issuing fatwas on Legal Texts: An Analytical Study

Abstract

ملخص البحث 

هدفت الدراسة إلى التعرف آداب المفتي والمستفتي والشروط الواجب توافرها في المفتي والمستفتي عند الإفتاء في النصوص الشرعية، وتكمن مشكلة الدراسة في إهمال اتباع الآداب المتعارف عليها للمستفتي والمفتي مما قد يؤثّر سلبًا في عملية الفتوي. وتبرز أهمية الدراسة في تسليط الضوء على آداب المفتي والمستفتي والشروط الواجب توافرها في المفتي والمستفتي عند الإفتاء في النصوص الشرعية، واتبعت الدراسة المنهج التحليلي لتحليل آداب المفتي والمستفتي والشروط الواجب توافرها في المفتي والمستفتي عند الإفتاء في النصوص الشرعية، كما اتبعت الدراسة المنهج الاستقرائي لاستقراء النصوص الشرعية من القرآن الكريم، والسنة النبوية المطهرة بخصوص آداب المفتي والمستفتي والشروط الواجب توافرها في المفتي والمستفتي عند الإفتاء في النصوص الشرعية. كما استخدمت الدراسة المنهج المقارن لمقارنة آداب المفتي بآداب المستفتي عن الإفتاء في النصوص الشرعية. ولقد توصلت الدراسة إلى عديد من النتائج من بينها أن المفتي يحاول أن يدرك المسألة إدراكًا صحيحًا، فإذا كان هناك نص صريح فإن صناعة الفتوى تكون واضحة، أما إذا كانت المسألة معقدة فإنه يستخدم القياس قدر الإمكان في عديد من المسائل المشابهة. ولقد أوصت الدراسة بضرورة الاحتكام إلى كتاب الله وسنة الرسول صلى الله عليه وسلم في صناعة الفتوي.

ABSTRACT

The study aims to identify the terms and conditions of mufti and the mufti (The Islamic Consultant and the consultee) and some of the conditions that must be met by the mufti and the mustafti when issuing fatwas in legal texts. The problem of the study lies in the habit of neglection to follow the recognized etiquette of the mufti and the mufti, which may negatively affect the fatwa process. The importance of the study is highlighted by shedding light on the etiquette of the mufti and mustafti and the conditions that must be met by the mufti and mustafti when issuing fatwas in legal texts. The study follows the analytical approach to analyze the terms and the conditions  with regards to the mufti and mustafti that must be met by the mufti and questioner when issuing fatwas in legal texts. The study also follows the inductive approach to extrapolate the legal texts. From the Holy Qur’an and the Sunnah of the Prophet regarding the etiquette of the mufti and mustafti. The study also uses the comparative approach to compare the etiquette of the mufti with the etiquette of the questioner regarding issuing fatwas in Sharia texts. The study finds that that the mufti tries to understand the issue correctly. If there is an explicit text, the making of the fatwa is clear, but if the issue is complex, he uses analogy as much as possible in many similar issues. The study recommended the necessity of resorting to the Book of Allah and the Sunnah of the Messenger, SAW, in making fatwas.
